Terms of sale and participation
These terms apply to the purchase of original works and to events with the artist arranged through these pages. For the other business areas of JTP Active Invest AG, the full General Terms and Conditions (PDF, version of 3 October 2026) apply.
1. Contracting party
The contracting party is in every case JTP Active Invest AG, Wassergrabe 6, 6210 Sursee, Switzerland, CHE-304.981.405, not the artist personally and no intermediary.
2. Offer and conclusion of contract
Information on these pages is non-binding and does not constitute an offer in the legal sense. A contract comes about only once we have submitted a written offer to you and you have accepted it. Binding prices are stated exclusively by JTP Active Invest AG, in writing in the offer.
3. Prices and value added tax
Prices are in Swiss francs and are understood to be exclusive of value added tax, unless expressly stated otherwise. Value added tax is currently 8.1 per cent and is shown separately on the invoice. This applies to original works, original designs, art prints, unique pieces from limited editions, commissioned works, events and to all three licences. There is no exception.
For deliveries and services to recipients outside Switzerland, the statutory rules on the place of supply and on exemption apply, provided the necessary evidence is available. Which rule applies in an individual case is stated in the offer.
4. Expenses and materials
Expenses and materials are always invoiced separately according to actual cost. These include travel from the artist's place of residence and, for multi-day or more distant events, accommodation and meals. We itemise these positions in the offer.
5. Payment
For commissioned works, a down payment is due when the commission is placed. From an order value of CHF 50,000 the 50/50 model applies: half when the commission is placed, half on handover of the finished work. Differing payment arrangements require the written form.
6. Transfer of ownership and delivery
Ownership of the work passes to you after payment in full. You receive the original together with the work dossier and certificate of authenticity and, if one has been prepared, the expert valuation. Transport and transport insurance are governed by the offer.
7. Rights to the motif
By purchasing an original you acquire the work as an object. The exploitation rights to the motif, for example for print, advertising or merchandising, remain with JTP Active Invest AG unless otherwise agreed in writing. For a commissioned work under Licence 2, the rights of use are governed by an individual contract.
8. The three licences
Licence 1 permits the use of a motif for one year in your own communication, without size restriction, and for articles sold or given away up to 100 items per product and licence year. Art prints and decorative prints for sale are excluded in any edition. CHF 1,750 excluding value added tax, term one year. Anyone wishing to exceed 100 items informs us beforehand; Licence 3 applies to the edition above that.
Licence 2 is the long-term use of a specially created commissioned work, for up to 99 years, combined with an appearance by the artist and exclusive rights to the motif. It is governed by a separate licence agreement. Price on offer, excluding value added tax.
Licence 3 applies from 101 items per product and licence year and to any industrial use and to packaging and labels. It is agreed individually in a licence agreement, with a base amount per motif and licence year and a per-item licence. All amounts excluding value added tax. Exclusivity is granted only for one industry and one territory. The edition must be notified to us before production.
9. Works created in front of an audience
A work created in front of an audience during live painting or bodypainting is not finished the same evening and cannot be handed over at the event. Completion comprises drying, the photography session and the final sealing lacquer. Anyone wishing to acquire such a work reserves it at the event; contract, payment and delivery follow afterwards.
10. Events
The date, scope and course of an event are agreed in writing. The host provides the premises and ensures the conditions for the appearance: in particular a clear area, sufficient lighting and a power connection. If an event cannot take place for reasons for which neither party is responsible, we look for a replacement date together.
11. Valuations and statements of value
An expert valuation is the assessment of an independent valuer as at a particular date. It is no assurance of a future value and no guarantee of an achievable price. Valuation figure, asking price and transaction price are three different quantities. JTP Active Invest AG makes no statements about future value development and promises no returns.
12. No buy-back
JTP Active Invest AG operates in the primary market. It gives no buy-back undertaking for works acquired, does not broker a secondary market and guarantees no price. Express written supplementary agreements in individual cases remain reserved.
13. Place of jurisdiction and applicable law
Swiss law applies. For all disputes arising from or in connection with these terms, the place of jurisdiction is the registered office of JTP Active Invest AG in Sursee, Switzerland. JTP Active Invest AG reserves the right to bring actions at the domicile or registered office of the contracting party as well.
14. Language and relationship to the full General Terms and Conditions
In case of doubt, the German version applies. For business areas outside original art and events, the full General Terms and Conditions (PDF, version of 3 October 2026) of JTP Active Invest AG apply; individual written agreements take precedence over these terms.
